Terms of Service

These Terms are the agreement between ESLgames.io and the adult or organization that creates an account. They set practical rules for accounts, classroom use, content, AI features, and paid plans.

These Terms of Service ("Terms") govern access to the ESLgames.io website, learning platform, games, practice activities, and related services (together, the "Service"). By creating an account or using the Service as an account holder, you agree to these Terms.

Agreement and eligibility

These Terms form an agreement between you and ESLgames.io ("ESL Games," "we," "us," or "our"). If you use the Service for a school, company, or other organization, you confirm that you have authority to accept these Terms for that organization. In that case, "you" includes both you and the organization.

Account holders must be at least 18 years old or the age of legal majority where they live and able to enter a binding contract. Students use the Service through an adult-managed class and do not enter this agreement merely by joining a class.

The Service

ESL Games provides ready-made English learning games, practice activities, vocabulary tools, class assignment features, student access, progress information, and optional AI-supported speaking activities. Features may vary by plan, location, device, or stage of product development.

The Service supports teaching and practice. It does not replace a teacher's professional judgment, guarantee a particular learning outcome, or provide an official grade, credential, or assessment. We may improve, add, limit, or discontinue features, but we will give reasonable notice when a material change significantly reduces a paid Service.

Accounts and security

You must provide accurate account information and keep your sign-in method secure. You are responsible for activity under your account and for promptly telling us about suspected unauthorized access. You may not share an account in a way that bypasses plan limits or let a student use an adult account.

Class codes and student access links should be shared only with the intended class. You are responsible for class names, rosters, assignments, and other settings you control. Contact us if you believe a class code or student credential has been exposed.

Student use

An account holder may invite students only for a legitimate educational purpose and only when authorized to do so by the student, parent or guardian, school, or applicable law. Use a first name or nickname where possible and do not submit birth dates, health information, disciplinary records, government identifiers, or other sensitive records unless we expressly support and agree to that use in writing.

If students may be under 13 in the United States, contact us before enabling their access unless your school has formally authorized the Service for its educational purpose. A school's ability to act for a parent is limited by law. These Terms do not transfer ESL Games' own obligations under children's privacy law to a teacher, school, parent, or student.

Account holders must provide students and families with any notices required by their institution or local law. Our collection and use of student information is described in our Privacy Policy.

Your content

"Your Content" means vocabulary, definitions, images, class names, assignments, and other material you upload or create through the Service. You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, display, and transmit it only as needed to provide, secure, maintain, and improve the Service.

You confirm that you have the rights and permissions needed to use Your Content and to let us process it as described here and in the Privacy Policy. Do not upload material that infringes intellectual-property, privacy, publicity, or other rights. You are responsible for reviewing learning content before assigning it to students.

Acceptable use

You may not use the Service to:

  • break the law or violate another person's rights;
  • upload harmful, abusive, discriminatory, sexually explicit, or otherwise inappropriate classroom content;
  • harass, identify, profile, or publicly expose a student;
  • probe security, bypass access controls, scrape the Service, or introduce malicious code;
  • reverse engineer or copy protected parts of the Service except where law expressly permits it;
  • resell, sublicense, or provide the Service as your own product without written permission;
  • use automated systems in a way that burdens or disrupts the Service; or
  • use student information for advertising, unrelated commercial profiling, or another non-educational purpose.

AI and speaking features

Optional features may use artificial intelligence to transcribe speech, conduct a practice conversation, generate an image, translate text, or give feedback. AI output can be inaccurate, incomplete, or unsuitable. You must review it before relying on it for teaching decisions.

Do not use AI feedback as the sole basis for a grade, placement, disciplinary action, diagnosis, or another decision with significant consequences. Microphone use is optional. Information sent to AI providers is handled as described in the Privacy Policy.

Paid plans and cancellation

If you purchase a paid plan, the checkout page will show the price, currency, billing period, included features, taxes or fees, renewal terms, and any trial or seasonal billing pause before you pay. Those checkout disclosures and any order confirmation are part of these Terms. If they conflict with this section, the more specific checkout disclosure controls.

Recurring plans renew until canceled. You may cancel through the available billing controls or by contacting us, and cancellation normally takes effect at the end of the current paid period unless the checkout terms or applicable law provide otherwise. Losing access to paid features does not automatically delete your account or data.

Refunds and statutory withdrawal rights depend on the purchase, location, and whether digital service has begun. Nothing in these Terms limits a non-waivable consumer right. If the law permits an exception to a cancellation right for immediately supplied digital service, we will disclose that exception and request any required consent before performance begins. A payment provider may act as merchant of record and apply additional checkout terms disclosed at purchase.

Our content and licenses

The Service—including its software, games, lessons, artwork, audio, design, trademarks, and ESL Games-created content—is owned by us or our licensors and protected by law. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the Service for personal, classroom, tutoring, or internal school purposes during your permitted access.

You may project assigned activities, share authorized student access, and use ordinary browser printing where a feature supports it. You may not extract or redistribute a game or content library, remove ownership notices, or create a competing product from the Service. Feedback and suggestions may be used without restriction or payment, but we will not publicly identify you as their source without permission.

Third-party services

The Service relies on providers for hosting, authentication, storage, AI processing, email, and payment functions. Some features may link to a third-party service or require its account. We do not control independent third-party services, and their own terms and privacy policies may apply. We remain responsible for our obligations when a provider processes information on our behalf.

Suspension and termination

You may stop using the Service at any time and may request account deletion. We may suspend or terminate access if you materially breach these Terms, create a security or safety risk, fail to pay an amount due, or use the Service unlawfully. When practical, we will give notice and an opportunity to fix the issue before termination, unless immediate action is reasonably necessary.

After termination, your right to use the Service ends. Provisions that reasonably need to continue— including ownership, payment obligations, disclaimers, liability limits, and dispute terms—remain in effect. Data handling after termination is governed by the Privacy Policy and applicable law.

Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free content, a particular learning result, or that AI output will always be accurate. These disclaimers do not exclude warranties that cannot lawfully be excluded.

To the extent permitted by law, neither ESL Games nor its suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities arising from the Service. Our total liability arising from the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or US$100.

These limits do not apply where prohibited by law, including liability that cannot be excluded for fraud, willful misconduct, gross negligence, personal injury, or violation of non-waivable consumer rights. Some places do not allow certain exclusions, so parts of this section may not apply to you.

Governing law and disputes

These Terms are governed by the laws of Taiwan, without regard to conflict-of-law rules. Courts located in Taiwan will have jurisdiction over disputes, except where the law where you live gives you a non-waivable right to bring a claim elsewhere. Before filing a claim, please contact us so we can try to resolve the issue informally.

Nothing in these Terms limits a consumer's right to contact a regulator, consumer-protection body, or other authority. If any provision is unenforceable, it will be adjusted only as much as needed, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver.

Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised Terms and update the effective date. For a material change, we will provide reasonable advance notice and request renewed agreement when required. Changes do not retroactively alter a dispute that arose before the updated Terms took effect.
