Privacy Policy

ESLgames.io helps teachers assign English practice and helps students complete it. We use the information needed to run those features. We do not sell personal information, show targeted advertising, or use student information for advertising.

This Privacy Policy explains how ESLgames.io ("ESL Games," "we," "us," or "our") handles personal information when you visit our website or use our learning platform, games, practice activities, and related services (together, the "Service").

Information we collect

Account and contact information

Teachers, tutors, parents, and school staff may provide an email address, display name, role, and sign-in information. If you use Google sign-in, we receive basic account details from Google, such as your name, email address, and account identifier. We also record whether you chose to receive teaching ideas or product updates.

Class and learning information

Account holders may create class names, assignments, release and due dates, vocabulary sets, terms, definitions, and learning images. A student who joins a class provides a name or nickname and a class code. The Service may record class membership, assigned content, game or practice activity, completion, answers, scores, accuracy, time spent, and points.

Device and service information

We and our hosting providers automatically receive limited technical information needed to deliver and protect the Service, such as IP address, browser and device type, requested pages, timestamps, error information, and security logs. We also collect limited product analytics, such as account sign-in, class creation, assignment, game-opening, class-joining, and practice completion events. Analytics events do not include names, email addresses, class names, class codes, answers, recordings, or transcript text.

Information stored on your device

Games and practice activities may store answers, attempts, completion results, preferences, and progress in your browser. This information can remain on that device until you clear the browser's site data.

How we use information

We use personal information to:

  • create accounts, authenticate users, and maintain student sessions;
  • provide classes, assignments, games, vocabulary tools, and progress reporting;
  • give teachers access to information about students in their classes;
  • generate private speaking feedback and translations when requested;
  • operate, secure, troubleshoot, and improve the Service;
  • respond to questions, rights requests, and support needs;
  • send teaching ideas or product updates when an account holder opts in; and
  • meet legal obligations and enforce our agreements.

Where applicable law requires a legal basis, we rely on performing our agreement with you or the organization providing the Service, consent, compliance with law, and our legitimate interests in providing and securing an educational service. You may withdraw consent where our processing relies on consent.

Students and children

Student access is designed to be set up and directed by a teacher, school, tutor, or parent—not as an independent account for a child. Students join with a class code and a name or nickname; the current student flow does not require an email address. We ask adults to use the minimum information needed, such as a first name or nickname, and not to upload sensitive student records.

For a child under 13 in the United States, a school may authorize collection on a parent's behalf only when the Service is used for the school's educational purpose and not for another commercial purpose. In other situations, verifiable parental consent may be required before the child uses the Service. Schools and other account holders should contact us before enabling access for children if they are unsure whether the required authorization is in place.

We do not sell children's personal information, use it for targeted advertising, or allow students to make it public through the Service. A parent or eligible school representative may ask to review, correct, or delete a child's personal information, or stop further collection, by contacting us. We may need to verify the request and the requester's authority.

Speaking and AI features

Some optional activities use a microphone and artificial intelligence to conduct a conversation, transcribe speech, evaluate an answer, create a practice image, translate feedback, or provide written coaching. When you choose one of these features, audio, transcript fragments, lesson context, selected vocabulary, and a pseudonymous safety identifier may be sent to OpenAI for processing.

ESL Games does not save raw microphone audio after processing. A transcript or answer may appear in feedback and, for some activities, may be stored in the browser's local storage. Requests are configured not to be stored as application content by the AI model, but OpenAI may retain limited API data temporarily for abuse monitoring or legal reasons under its business-data terms. OpenAI states that API inputs and outputs are not used to train its models by default.

AI feedback can be incomplete or inaccurate. It supports language practice and is not used to make legal or similarly significant decisions about a student. Microphone access is optional and can be declined in the browser.

To monitor AI reliability and cost, PostHog receives operational metadata such as the model name, latency, token counts, request status, and error state. Prompts, audio, transcripts, answers, AI responses, and generated images are excluded from this telemetry.

When we share information

We disclose information only as needed for the purposes described above:

  • Teachers and organizations. A class owner can see student names, class membership, assigned work, and available progress information for that class.
  • Service providers. We use providers such as Supabase for authentication, databases, and file storage; Vercel for hosting; Google for optional account sign-in; PostHog for limited product analytics; and OpenAI for optional AI and speaking features. Fonts and game libraries are served from our own site, not from a third-party font or script network. These providers process information under their own terms and our instructions where applicable.
  • Legal and safety reasons. We may disclose information if reasonably necessary to comply with law, protect a person, investigate fraud or abuse, or protect the Service and our rights.
  • Business changes. Information may be transferred as part of a merger, financing, reorganization, acquisition, or sale of assets, subject to appropriate protections.

We do not sell personal information or share it for cross-context behavioral advertising.

Cookies and local storage

We use cookies that are necessary for account authentication, security, and student sessions. These include a signed student-session cookie that can remain for up to one year unless it is cleared or invalidated. We also use browser local storage to remember game state, practice attempts, completion, layout choices, and language preferences. Our analytics configuration does not use persistent analytics cookies or browser storage, automatic click or form capture, or session replay. We do not currently use advertising cookies.

Blocking essential cookies may prevent sign-in or student access. You can clear locally stored information using your browser's site-data controls, but doing so may reset progress saved only on that device.

How long we keep information

We keep account, class, learning, and uploaded content while it is needed to provide the Service, maintain appropriate educational records, comply with law, resolve disputes, and protect the Service. Removing a student or archiving a class may hide it from active use without immediately deleting every related record. You may request deletion as described below.

Browser-stored information remains until it is cleared. Security and operational logs are retained for a limited period based on need and provider settings. Raw speaking audio is not saved by ESL Games; our AI provider may keep limited API data for up to 30 days by default for abuse monitoring, unless law requires longer retention or different account controls apply.

Your choices and rights

Depending on where you live, you may have rights to access, review, obtain a copy of, correct, delete, restrict, or object to the processing of personal information, and to data portability. You may also withdraw consent and complain to a privacy regulator. Taiwan residents have the rights provided by Article 3 of Taiwan's Personal Data Protection Act, subject to lawful exceptions.

To make a request, email hello@eslgames.io. Tell us whether the request concerns an account, a class, or a student. We may verify your identity and, for student data, your authority as a parent, school, or class owner. You may opt out of non-essential email by using its unsubscribe link or contacting us. We do not discriminate for exercising privacy rights.

If you choose not to provide required account or class information, we may be unable to create an account, join a class, or provide the requested feature. Optional marketing and microphone access are not required for the Service's core classroom features.

Security and international transfers

We use administrative, technical, and organizational safeguards intended to protect information, including access controls, signed credentials, encrypted network connections, and database authorization rules. No method of storage or transmission is completely secure.

We operate from Taiwan and use service providers in other countries, including the United States. Information may therefore be processed outside your country, where privacy laws may differ. Where required, we use an appropriate legal mechanism for international transfers.

Changes to this policy

We may update this policy when the Service or legal requirements change. We will post the updated version here and change the effective date. If a change materially affects how we use student or child information, we will provide additional notice and obtain consent when required.
